What is an Impressum?

An “Impressum” is a mandatory page for websites and online services targeting the German market and is similar to a colophon. It contains key company information and contact details, so that visitors can easily find out who is responsible for the website. An Impressum is also important when you start working on SEO in Germany.

The requirement for an Impressum stems from the German Telemedia Act (TMG), which stipulates that online transparency and the allocation of responsibility are necessary. For Dutch companies, this means that an Impressum is required as soon as you offer services or products to German consumers or businesses.

Why do you need an “Impressum”?

Germany has strict rules regarding consumer protection and business information. An “Impressum” ensures transparency and builds consumer trust, while also preventing legal risks. The absence of a complete or correct legal notice can result in fines of up to €50,000 or legal action; these regulations are actively enforced.

Furthermore, having an Impressum demonstrates that your company complies with local laws and regulations, which builds trust with your customers in Germany. If you don’t have an Impressum on your German website at all, your German audience will immediately realize they’re dealing with a foreign company, which can be off-putting.

What should be included in a legal notice?

A complete and accurate legal notice must include specific information, such as:

  • The name and business address of your company.
  • Contact information, such as a phone number and email address.
  • Registration information, such as your Chamber of Commerce number and VAT number.
  • The person in charge, often the director or a company representative.
  • Legal disclaimers and, if applicable, a privacy statement.
  • Regulatory agency or professional association (if applicable).

Please note that an “Impressum” must be clearly visible on your website; the most common way to do this is via a link in the footer.

Common Mistakes When Creating a Legal Notice

Dutch companies sometimes run into problems when drafting their legal notice. Common mistakes include:

  • Incomplete or outdated company information.
  • An “Impressum” that is not easily accessible (for example, hidden in a submenu).
  • Failure to designate a responsible contact person.

By avoiding these mistakes, you can significantly reduce the risk of legal problems.

Be prepared with a complete legal notice

If you operate in Germany, an Impressum is not only a legal requirement but also an opportunity to come across as transparent and trustworthy. Make sure your legal notice is complete, up-to-date, and easy to find on your website. This will help you avoid potential fines and strengthen your customers’ trust in Germany. You can find all the information in German on the websites of the DSK (Data Protection Conference) and the IHK (Chamber of Industry and Commerce).
